Cannabis associations are constituted under the legal protection of Law 1/2002, of March 22, which regulates the right of association, and based on the argument of joint and/or shared consumption among adult substance consumers.
Cannabis social clubs or cannabis associations “cannot distribute cannabis in a stable and institutionalized manner” under any circumstances, as this could lead to charges against the CSC Board for crimes against public health and membership in a criminal organization, as established in numerous higher court judgments.
Likewise, caution must be exercised and it must be considered that the amount allowed in the premises must not exceed the limits established in the equivalence table of the National Institute of Toxicology. Therefore, you would need to multiply 3-5 grams per person/day by the number of association members.
Cannabis smokers’ associations can self-supply cannabis through two means: shared cultivation or joint purchasing.
If joint purchasing is chosen as the source of cannabis access in the statutes, it is essential to draft joint purchase records with the consumption forecast for each member within a 5-day period.
On the other hand, if shared cultivation is chosen, a cultivation manifesto must be created with the characteristics of the cultivation, which must also meet the anticipated needs of the different members.
In Spain, we are still awaiting more specific regulations governing the consumption of substances derived from cannabis.
